What is Chapter 7 Bankruptcy?

Filing for bankruptcy under Chapter 7 of the Bankruptcy Code is generally the simplest and quickest form of bankruptcy and is available to married couples, individuals, partnerships, and corporations. Also called liquidation bankruptcy, this legal process is designed to free you from unsecured debts, including:

  • Credit card debt
  • Medical bills
  • Unpaid utility bills
  • Payday loans
  • Some personal loans

Once you are approved for Chapter 7 bankruptcy, you will have to undergo credit counseling prior to filing. As soon as your petition has been filed, an automatic stay will take effect which prevents creditors from contacting you while your case is pending. In many cases, it takes between three and four months to receive a discharge.

There are many benefits to filing for Chapter 7 bankruptcy:

  • Creditors cannot make collection efforts
  • Most, if not all, of your unsecured debts will be discharged
  • You are not required to enter into a debt repayment plan
  • There is no limit to the amount of debt you can have

Am I Eligible to File for Chapter 7 Bankruptcy?

Not everyone will qualify to file under Chapter 7. Those who wish to file for bankruptcy under Chapter 7 must pass a bankruptcy “means test,” which is a measure of your income, assets, and debts and how it compares to the median household income in your area. This test was created to ensure that those who are capable of paying back some of what they owe do so under the right Chapter. Request a free consultation with Boss Law to find out more.
