How does this happen? Most often background check reports get “mixed” between two people – usually with similar names or social security numbers.
This is very concerning because 65 million Americans have criminal records – that is nearly 1 in 5 Americans!
The most common background check error occurs when someone with NO criminal record gets their file mixed with someone that DOES have a criminal record.
So, if this happens – what do you do?
First: You are entitled to a copy of the background report from the employer – the employer MUST give you a copy of the report. Typically, an employer hires a credit bureau or consumer screening company to create the report. The employer is required to give you the contact information for the screening company.
Second: Review the report and check it for errors. Errors can range from simple mistakes – like a wrong address. Other mistakes can be crucial — criminal records that are not yours, incorrect credit information, and identity theft.
Third: Employers, credit bureaus and background screening companies MUST fix the mistake. The best way to fix it, is to send certified letters to the credit bureaus and background screening companies providing proof of the mistake.
Fourth: Follow up!!! Often the credit bureaus and screening companies will not respond – the Fair Credit Reporting Act requires that the credit bureaus and screening companies either fix or respond to the dispute within 30 days.
